- The price is subject to change without notice until a formal purchase agreement is signed

- The Seller reserves the right to refuse any offer or withdraw the Domain from sale at any time
1.2 Purchase Process
- All transactions must be completed through a secure escrow service (e.g., GoDaddy, Escrow.com)
- Buyer is responsible for all escrow fees unless otherwise agreed in writing
- Payment must be made in full before domain transfer is initiated
- Domain transfer typically takes 5-10 business days after payment clearance
1.3 Payment Terms
- Accepted Payment Methods: Bank transfer, wire transfer, credit card (via GoDaddy), cryptocurrency (with approval)
- Installment Plans: Available through GoDaddy with credit approval
- Refund Policy: All sales are final. No refunds after domain transfer is completed
- Currency: All prices are in USD unless otherwise specified
2. Domain Transfer
2.1 Transfer Process
- Domain will be transferred via registrar transfer (EPP code/Authorization code)
- Buyer must have an account with a domain registrar (e.g., GoDaddy, Namecheap, Google Domains)
- Seller will unlock the domain and provide the transfer authorization code
- Buyer must accept the transfer within the timeframe specified by the registrar
2.2 Seller Responsibilities
- Provide a clear, unencumbered domain with no liens or legal disputes
- Unlock the domain and disable transfer protection
- Provide the EPP/Authorization code within 24 hours of payment confirmation
- Assist with technical transfer issues within reasonable limits
2.3 Buyer Responsibilities
- Ensure registrar account is active and in good standing
- Accept the domain transfer promptly
- Update domain contact information and DNS settings as needed
- Pay any applicable registrar transfer fees
3. Representations and Warranties
3.1 Seller Representations
The Seller represents and warrants that:
- They are the lawful owner of BiteToy.com
- They have the right to sell the Domain
- The Domain is free from liens, encumbrances, and legal disputes
- The Domain does not infringe on any trademarks or intellectual property rights (to the best of their knowledge)
3.2 Buyer Representations
The Buyer represents and warrants that:
- They have the financial capacity to complete the purchase
- They will not use the Domain for illegal purposes
- They will comply with all applicable laws and regulations
- They have conducted their own due diligence regarding the Domain
3.3 No Additional Warranties
Except as expressly stated above, the Domain is sold "AS IS" without warranties of any kind, including but not limited to:
- Merchantability or fitness for a particular purpose
- Traffic, revenue, or SEO performance
- Future value or appreciation
- Social media availability or trademark clearance
4. Intellectual Property
4.1 Trademark Disclaimer
BiteToy.com is offered as a domain name only. The Seller makes no claims regarding trademark availability. Buyer is responsible for:
- Conducting trademark searches in relevant jurisdictions
- Obtaining any necessary trademark registrations
- Ensuring the domain does not infringe on existing trademarks
- Defending against any trademark disputes after purchase
4.2 Post-Sale Rights
After transfer, Buyer obtains full ownership rights to the domain name, including:
- Right to use, sell, or transfer the domain
- Right to develop a website or business using the domain
- Right to apply for trademark protection (subject to trademark law)
5. Limitation of Liability
5.1 No Consequential Damages
To the maximum extent permitted by law, Seller shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
- Loss of profits or revenue
- Loss of business opportunities
- Loss of data or information
- Costs of procurement of substitute goods or services
5.2 Maximum Liability
Seller's total liability for any claims related to the Domain sale shall not exceed the purchase price paid by Buyer.
5.3 Exceptions
These limitations do not apply to liability for fraud, willful misconduct, or gross negligence.
6. Dispute Resolution
6.1 Negotiation
Parties agree to first attempt to resolve any disputes through good faith negotiation.
6.2 Mediation
If negotiation fails, parties agree to attempt mediation before pursuing legal action.
6.3 Arbitration
Any disputes not resolved through negotiation or mediation shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
6.4 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
7. UDRP and Legal Disputes
7.1 UDRP Awareness
Buyer acknowledges awareness of the Uniform Domain-Name Dispute-Resolution Policy (UDRP) and agrees to defend against any UDRP complaints after transfer.
7.2 Indemnification
Buyer agrees to indemnify and hold harmless Seller from any claims, disputes, or legal actions arising from Buyer's use of the Domain after transfer.
8. Confidentiality
Both parties agree to keep all transaction details confidential, including:
- Purchase price and payment terms
- Negotiation discussions and correspondence
- Personal and financial information
This confidentiality obligation survives the completion of the transaction.
9. Force Majeure
Neither party shall be liable for delays or failures in performance resulting from causes beyond their reasonable control, including but not limited to:
- Natural disasters, pandemics, or acts of God
- Government actions, wars, or terrorism
- Internet or telecommunications failures
- Registrar technical issues or downtime
10. Modification of Terms
Seller reserves the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last Updated" date. Continued negotiation or use of the website after changes constitutes acceptance of modified Terms.
11. Entire Agreement
These Terms, together with any formal purchase agreement, constitute the entire agreement between parties and supersede all prior discussions, negotiations, and agreements.
12. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
13. No Agency Relationship
Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship between Buyer and Seller.
14. Assignment
Buyer may not assign or transfer their rights or obligations under these Terms without Seller's prior written consent.

16.1 Due Diligence Period
Buyer may request a 24-48 hour due diligence period after offer acceptance to verify domain details. During this period, a small deposit may be required to hold the domain.
16.2 Domain Holding
If Buyer requires time to secure financing, Seller may agree to hold the domain for up to 30 days with a non-refundable deposit (typically 10% of purchase price).
16.3 Bulk Discount
If Buyer is interested in purchasing multiple domains, contact us for potential volume discounts.
